The actual clause doesn't say anything about Liverpool having to sell at £40m. That's why it wasn't breach of contract.This is correct. Suarez had a clause but Liverpool knew that they could still refuse to sell and it would take Suarez suing Liverpool for breach of contract or something that would take longer to resolve than the transfer window would be open so Liverpool knew they could just make Suarez back down and he couldn't force transfer.
